Google buys IBM patents to beef up portfolio (AFP)

NEW YORK (AFP) ? Google has bought more than 1,000 technology patents from IBM as the Internet giant seeks to build up its portfolio and head off potential intellectual property suits.

"Like many tech companies, at times we'll acquire patents that are relevant to our business needs," a Google spokesman said in a statement Friday. "Bad software patent litigation is a wasteful war that no one will win."

The Google spokesman declined to comment on the financial details of the transaction. IBM declined comment.

According to the blog SEO by the Sea, Google recorded with US authorities in mid-July that it had been assigned 1,030 patents from IBM on a range of topics, "from the fabrication and architecture of memory and microprocessing chips, to other areas of computer architecture, including servers and routers."

Google recently lost out on an auction for some 6,000 patents held by bankrupt Canadian firm Nortel. The winning $4.5 billion bid came from a consortium consisting of Apple, EMC, Ericsson, Microsoft, Research in Motion and Sony.

The huge sum spent on the patents and the involvement of many of the world's top tech companies reflected the fierce battle for intellectual property in the tech industry, where firms are often hit with patent-infringement lawsuits.

Google is currently being sued by software giant Oracle over technology used in its Android smartphone operating system.

The threat of more such lawsuits spurred Google to make its $900 billion bid to buy the patent portfolio of Nortel, a once-pioneering developer of wireless and fiber-optic technology.

These days, everyone?s lives are burdened with paperwork. With newspapers, magazines, bills, junk mail, and who-knows-what taking up space in their day, few people have time to look at every piece of paper that comes their way. Failure to do so could raise the interest rate on your credit card substantially.

Another ?fine print? issue that has been turning up recently is the prepayment penalty that is now being attached to up to half of all mortgages and homeequityhelp.net home equity loans. Your failure to do so could cost you quite a bit of money.

Stocks, dollar fall as debt default looms (Reuters)

LONDON (Reuters) ? Global stocks fell to their lowest in more than a week on Thursday, knocked down by mounting concerns about a U.S. debt default which also kept the dollar subdued against the safe-haven Swiss franc and the yen.

European stocks fell for the fourth straight session, following their Asian counterparts, as sovereign debt risks weighed on sentiment and drove investors away from riskier assets to safer ones such as gold.

Stalemate in Washington over lifting the debt ceiling is increasing the possibility of a U.S. credit rating downgrade and has raised the prospect that the government of the world's leading economy will run out of money to pay its bills.

"The problem is that the whole thing has been a wake-up call for the market, a real black swan: we're now starting to price in a default risk for the world's biggest economy, which was inconceivable just a few months back," said David Thebault, head of quantitative sales trading at Paris-based broker Global Equities.

European stocks (.FTEU3) were also hurt by a raft of mixed earnings reports which sparked worries about company profits.

Banks were among the top losers, led by Credit Suisse (CSGN.VX), down 3.6 percent. The Swiss lender posted lower-than-expected quarterly net profit, hit by weak trading activity, and said it would cut about 2,000 jobs.

World shares as measured by MSCI (.MIWD00000PUS) were down 0.3 percent while the MSCI index of Asia Pacific stocks outside Japan (.MIAPJ0000PUS) was down 0.85 percent, with technology, commodity-related and consumer shares the biggest drags.

The safe-haven yen was the main beneficiary of poor risk sentiment, making gains against both the euro and the dollar.

The greenback also hovered near a record low against the Swiss franc with investors increasingly downbeat about its prospects on concerns that deficit reduction proposals being discussed in Washington may fall short of the budget cuts necessary to avert a U.S. debt downgrade.

EUROPEAN WORRIES

The deadlock in Washington has not pulled traders' attention away completely from the euro zone, where Italian and Spanish bond yields keep rising relative to German bonds and calm after last week's second bailout for Greece has evaporated.

"At the moment it's all about the U.S. debt ceiling," said David Bloom, global head of FX research at HSBC. "But if you ask which of these debt crises you would prefer, the answer is neither."

The 10-year Spanish/German bond yield spread widened 7 basis points on the day to 341 bps, while the equivalent Italian/German bond yield spread widened 10 basis points on the day to 322 basis points.

Attention is now on an Italian bond auction as investors try to gauge appetite for its high-yielding paper amid concerns the debt crisis could spread to the euro zone's No. 3 economy.

Japanese fund managers slashed their euro zone bond weighting to a record low and cut their U.S. bond allocations, while raising their Japanese bond weighting to a fresh all-time high, a Reuters poll showed.

U.S. 10-year Treasuries edged higher, stabilizing after falling overnight on a less-than-stellar auction of new five-year bonds. The 10-year yield was at 2.97 percent, a basis point below where it finished last night in New York.

With a ratings downgrade possible at any time, investors also kept a wary eye on U.S. credit default swap rates. The one-year CDS blew out to a record 85 basis points, pushing out the difference over five-year CDS to more than 20 basis points.

Gold has been a big winner as investors seek out hard assets to hedge against risks. Gold was steady at $1,617.80 an ounce after hitting an all-time high of $1,628 on Wednesday.

Brent crude was 0.7 percent higher at $118.20 a barrel.

A health insurance exchange should objectively and impartially provide information for consumers using simple language that is easy to understand. Some people have suggested that the search results be randomized so that there is no alphabetical preferential treatment. In other words, if the search results are alphabetical every time, Aetna will always be seen much earlier than United Healthcare. This is not objective and impartial.

A health insurance exchange will not function as an insurance provider. In other words, they will not be the insurer themselves. They would similarly to an insurance broker, however, without the customer service provided by licensed insurance brokers. A health insurance exchange would contract with private health insurance companies to offer their plans and policies, and to provide this information and quotes to consumers.

There were a few health insurance exchange set up already in the United States, most notably in Massachusetts (Massachusetts Connector) and Utah (Utah Health Exchange). These have been good examples for how a health insurance exchange is supposed to work. There is also a New York-based, non-profit health insurance exchange called Health Pass. However, there has also been a couple of failed health insurance exchange in Texas and California. These two health insurance exchange resulted in higher premiums, and ?cherry-picking? of customers.

Obviously, it is hoped that each state will implement and administer an excellent quality health insurance exchange within each state. Some states have chosen to administer these themselves, while others have allowed the federal government to run that state?s health insurance exchange. The debate has been over how to fund this plan. Some experts believe a health insurance exchange helps facilitate the enrollment of more American citizens into a health care plan, while also providing structure and supervision to the current health insurance market.

The Patient Protection and Affordable Care Act of 2010 (PPACA) has set up for the implementation of the health insurance exchange, but there is still some leeway regarding how it is to be set up, and how each state should handle it. There are also questions regarding whether the federal health insurance exchange will include a government-run insurance option. Although this was originally a part of the health reform bill, it was removed before it passed.

At this time, it appears as though a health insurance exchange will provide a web portal with information and quotes about health insurance plans, which it is hoped will result in more American citizens enrolling in an affordable health insurance plan.

Debt-ceiling outcome as unclear as ever (AP)

WASHINGTON ? Demoralized House Republicans are trying for a third straight day to pass a debt-ceiling bill that has almost no chance of surviving the Senate, even as the clock ticks closer to next week's deadline for avoiding a potentially calamitous government default.

House Speaker John Boehner, R-Ohio, suffered a stinging setback Thursday when, for a second consecutive day, he had to postpone a vote on his proposal to extend the nation's borrowing authority while cutting federal spending by nearly $1 trillion.

"Obviously, we didn't have the votes," Rep. David Dreier, R-Calif., said after Boehner and the GOP leadership had spent hours trying to corral the support of rebellious conservatives.

Republicans will try again Friday. If they continue to fail, then President Barack Obama and Senate Democrats will have extensive leverage to shape a bill to their liking and practically dare the House to reject it and send the nation into default.

If, however, Republicans can get Boehner's version through the House, a rapid and complex set of choices will determine whether and how a debt crisis can be averted. House Republicans will be under tremendous pressure to pass something, even if they have to make it so appealing to their right wing that the nation's independents and centrists will laugh it off. As Thursday's events proved, nothing is guaranteed.

The main area of dispute between the two parties is how to encourage or guarantee big spending cuts in the future without rekindling a fiercely divisive debt-ceiling debate such as the one now raging.

Interviews with well-placed insiders suggest the following road map, assuming Boehner can get his bill out of the House:

The Democratic-controlled Senate would kill it quickly. The focus then would fall on the Senate's two leaders, Democrat Harry Reid of Nevada and Republican Mitch McConnell of Kentucky. They must decide whether they can reach a compromise that can pass the Senate ? where a united GOP can kill bills with filibusters ? and then pass the House and be signed by Obama. The White House would be integral to such talks.

Republican officials say McConnell could hold a strong hand, despite the House's shaky performance. He could argue that the House finally passed a bill to raise the debt ceiling, while the Senate has done nothing but kill that bill. If Tuesday's deadline passes with no resolution, Republicans say, voters will blame Democrats.

Under this thinking, the Senate would pass a measure similar to the House bill, perhaps with minor changes to save face and give political cover to Democrats who vote for it. The House would quickly concur, with numerous Democrats and all but the most conservative Republicans voting aye. Obama would have no choice but to sign it.

Democrats say the opposite is true. Obama has persuasively argued in recent weeks that Republicans are unreasonably demanding, they say.

Democrats control the Senate and White House. If Republicans insist that a partisan, House-passed bill is the only vehicle, then public anger will fall on them, this thinking goes.

The biggest sticking point is the House bill's call for congressional votes to raise the debt ceiling, in two stages, before the 2012 elections.

A $900 billion debt-limit hike would come first, coupled with $917 billion in spending cuts over 10 years. A second vote, late this year or sometime next year, would allow another $1.6 trillion in borrowing power, provided that Congress and the president have agreed to another round of spending cuts of that amount or more.

Obama has consistently rejected this condition. He says it would hurt the economy and touch off another ferocious political fight over the debt ceiling, which Congress previously raised with little fuss year after year. Global markets and investors would not be reassured by such a drawn-out, uncertain scenario, he says.

The White House says the prospect of an economically devastating default must not be used as the "trigger" to force Congress to cut the deficit. Such triggers would take effect automatically if Congress did not act on a prescribed deficit-reduction package.

Those could include deep cuts in programs such as Medicare and Medicaid, which would be painful to Democrats, and tax increases that Republicans would be loath to accept. But Republicans believe the threat of default is a much stronger incentive to shrink the deficit.

Presidential adviser David Plouffe told MSNBC on Thursday that the Republican House bill would "have this whole debt ceiling spectacle, three-ring circus ... repeated again a few months from now, over the holidays. You know, the debt ceiling debate would ruin Christmas."

If the House sends Boehner's bill to the Senate, a crucial point in the end-game scenario will come when McConnell decides whether to insist on the House proposal to raise the debt ceiling in two steps, both tied to large mandatory spending cuts. If he does, then Reid and Obama will have to decide whether to swallow the demand or let the impasse last beyond Tuesday, and blame McConnell.

Or, McConnell could yield. He could help pass a Senate bill that lets the second debt-ceiling hike take place more easily, with an incentive mechanism for spending cuts that stops short of a mandate.

That would hand a tough choice to Boehner. His tea party conservatives would howl in protest. It's possible that 100 or more of his 240 House Republicans would vote against such a Senate-passed bill.

The measure presumably would pass anyway, with ample Democratic votes. But Boehner's hold on the speakership could be weakened.

Of course, little or none of this might transpire if the House can't figure out how to pass a bill. In that case, Obama would seem to hold almost all the cards.

Systemic Chemotherapy was poorly tolerated,and there was one chemotherapy-related death. Sixteen patients (84%) experienced good to excellent palliation. Three patients are currently living with no evidence of recurrent disease at 10,35,and 43 months. The median overall survival was 13 months and median disease-free survival of 11 months. The overall and disease-free survival 3 years were 17% and 22%,respectively. Patients with epithelial Malignant Pleural Mesothelioma had significantly better overall survival (p = 0.037) and disease-free survival (P = 0.02) than patients with sarcomatous or biphasic malignant pleural mesothelioma.

Another study called,"Cisplatin administered by the intracavitary pathway as a treatment for malignant mesothelioma "by Maurie Markman MD,Stephen Cleary PA-C Craig Pfeifle MD,Stephen B. Howell MD,Cancer Volume 58,Issue 1,pages 18-21,January July 1986. Here's an excerpt:"Abstract ?Twenty-one patients with malignant mesothelioma treated with an experimental chemotherapy regimen of weekly intracavitary intraperitoneal or intrapleural cisplatin (90-100 mg/m2) with simultaneous intravenous sodium thiosulfate delivered to protect against cisplatin-induced nephrotoxicity. One of the eight patients (12.5%) who intrapleural therapy and nine of 13 patients who demonstrated objective evidence of intraperitoneal therapy,clinical response,including three surgically defined large tumor regressions (23%). Patients receiving intrapleural treatment had more advanced disease prior to therapy than those who intraperitoneal therapy. It was concluded that intraperitoneal cisplatin is an active treatment program for localized intra-Abdominal Mesothelioma. Additional testing of intrapleural cisplatin should be performed in a patient population with less advanced disease or after surgical debulking. "Cancer 58:18-21,1986.

WASHINGTON (Reuters) ? The perception by teenagers and young adults that heavy cigarette smoking is a high-risk activity has declined in many states, according to a U.S. study on substance abuse and mental health released on Thursday.

The perceived risks of smoking one or more packs of cigarettes a day dropped between 2007-2008 and 2008-2009 in 14 states among youths aged 12 to 17, and in 31 states among those aged 18 to 25.

Perceived smoking risks also dropped in nine states among those 26 and older, a statement from the Substance Abuse and Mental Health Services Administration said regarding the report.

?No state is free from the unique impact of mental and substance use disorders,? SAMHSA administrator Pamela Hyde said in a statement.

?Data like these give states the information they can use to target their prevention and treatment activities for the greatest benefit to their residents,? she said.

Results from the 2008-2009 National Surveys on Drug Use and Health offer data on the specific behavioral health issues that affect each state. Other data included information on illicit drug use and mental illness.

The study said illicit drug among adolescents between ages 12 and 17 dropped in 17 states between 2002-2003 and 2008-2009.

States with the highest marijuana use, like Alaska, Colorado, District of Columbia, Hawaii, Maine, Massachusetts, New Hampshire, Oregon, Rhode Island and Vermont, were also the states with the highest rates of illicit drug use among people 12 or older.

Some 7.2 percent of Rhode Island?s adults experience serious mental illness, the highest level in the nation. Hawaii and South Dakota shared the lowest rate of 3.5 percent.

Ken Dychtwald Ph.D.: The Path to a Successful Retirement: Lessons from the Trailblazers

The financial "reckoning" we have just gone through has caused many of us to seriously rethink our current lives and future retirements. While many Americans got pretty shaken up over this past decade, most of us are emerging wiser, more disciplined and with a more pragmatic approach to a new kind of retirement.

Discovering the Path to a Happier Retirement

To find out exactly how different groups of retirees are faring in this stage of their lives and to learn what psychological, social and financial factors contribute to their happiness, my firm Age Wave recently joined forces with SunAmerica and Harris Interactive to conduct The SunAmerica Retirement Re-Set Study.

In our comprehensive survey of one thousand men and women 55+, we set out to reveal what the different types of retirement experiences are today, and the key factors that lead to a happy and secure retirement.

Meet the Four Faces of Retirement

We discovered that there are four distinct retiree types -- each with its own psychological, lifestyle and financial profile.

The first and most turned-on segment of retirees (20% of the total) we've named the Ageless Explorers. For them, retirement is a positive and fulfilling new chapter in life, an opportunity for new experiences, encore careers, and continued personal growth. They gave decades of thought to the retirement lifestyle they desired and planned accordingly. They are the most likely to have developed solid financial plans for managing both their savings and lifetime income and they are highly likely to have taken advantage of professional retirement planning advice along the way. The damage they experienced during the recession feels behind them now. In fact, most report that their financial strength is stronger now than before the economic downturn. In addition, in the SunAmerica Retirement Re-Set Study, each segment received a grade for their level of retirement happiness. Ageless Explorers gave themselves an A.

Cautiously Contents (18 percent of all retirees) are living a more traditional version of this phase of life. Less interested in new careers or the potential stress of personal reinvention, for them, retirement is a pleasurable time for relaxation and a life of leisure after decades of hard work. And they're enjoying it! Most of this segment are cautious planners -- and their risk-aversion has surely helped them avoid or weather the recent financial storm. With their proclivity for planning, they are far more likely to have developed a long term plan for saving and investing (75 percent) . They are inclined to value professional financial advice to help protect their retirement savings and lifestyle. Most currently find their financial situation to be in good shape. Their retirement happiness grade = B.

The next two segments are doing less well in retirement. While fate, misfortune and back luck have had something to do with their difficult circumstances, the kind of retirement they're experiencing is also a result of their own life choices.

Live for Todays (27 percent) have many ambitions and dreams for their retirement. Unfortunately, because they took too few steps to sufficiently prepare financially for their longer lives, retirement is a time of continual uncertainty and anxiety. While "back in the day" they might have imagined that everything would simply work out, in their maturity they're living through the downstream effects of the absence of responsible planning. Many are forced to work in retirement, not for the satisfaction and stimulation, but because they need money to pay the bills. Unfortunately, today they're living with the bad choices -- or absence of choices -- they made years ago. This segment was very hard hit by the recession, and are now grappling with increasing financial stress and tensions. For their retirement happiness grade, they gave themselves a C.

Worried Strugglers is the largest of the four segments (35 percent). For this group, retirement is a time of considerable anxiety and stress. Often overwhelmed -- and usually struggling, they have little interest in new experiences, staying productive, or even focusing on relationships with friends and family. Mostly they feel worried. They also are the most likely of the segments to have been dealt an unfortunate financial or health blow. To make matters worse, because during their working years they had done so little to plan for what they wanted to do in retirement, their options are now severely limited. It is important to note that it wasn't just a run of bad luck in maturity that impacted these men and women. In fact, they readily admit that they didn't take the best care of their physical or fiscal health when they were younger. They did little saving and investing for retirement -- and spent too little time nourishing their friendship networks. Now they often have to rely on other family members for support. The recession made them significantly more vulnerable and further increased their financial insecurities. Retirement happiness grade = D-.

Lessons from the Trailblazers

By "reverse engineering" the four segments, we can readily see that the type of retirement people have is not just a matter of luck. Ageless Explorers and Cautiously Contents are enjoying their retirement with a high level of happiness and financial security. Live for Todays and Worried Strugglers are having a hard time of it due to misfortune and/or questionable planning. Although some retirees were dealt a bad hand, preparation and self-discipline play a powerful role in creating a happy and successful retirement. For example, while 72 percent of "Ageless Explorers" had a clear plan for managing their savings and income only 25 percent of the "Worried Strugglers" did. And, while 79 percent of the "Cautiously Contents" made it a practice to avoid high interest debt, only 51 percent of the "Live for Todays" did. Overall, "Ageless Explorers" and "Cautiously Contents" were far more likely to plan, making the right lifestyle and financial moves in their 40s, 50s and 60s to achieve a secure and fulfilling retirement. Five New Rules for the New "Retirement Re-set."

Just as any navigators will take into account the successes and failures of those who have gone before, based on these study findings, we can begin to craft a map of the path to a successful and secure retirement. This journey includes five key ingredients.

First, since hardly anyone can afford a 20+ year, non-working retirement anymore, we should all expect to work a bit longer. That could be a good thing for all of us. Studies consistently show that retired people who stay engaged and productive are happier and healthier, than those who move to the sidelines.

Second, another helpful rule for the new retirement is the importance of financial planning. While living in the "here and now" is a wonderful approach to staying mindful, as a financial strategy it's a disaster. In this era of 401(k)s and volatile markets, help helps: trusted financial advisors can provide valuable assistance to what is no longer a "do-it-yourself" project. And, the earlier one begins this process, the more likely there will be a sustainable outcome.

The third rule is to keep learning and growing. Learn about new ideas, media and technologies, take an interest in the lives and interests of younger people, continually stretch yourself, try new things, and keep growing -- that is what can help bring your retirement years alive.

Fourth, it's time to buckle up and start living within our means. Far too many of us have fantasized a style of life not matched by our ability to pay for it. This new era of increasing longevity and economic restructuring calls for greater financial self-discipline among all of us.

Fifth, try to live the next chapter of your life with "purpose." A great deal has been said about how to live longer (eat your veggies, get a good night's sleep, practice yoga etc.), yet there's been far too little discussion about what to do and who to be in retirement to feel a sense of purpose and happiness. We desperately need a new version of maturity in which older people are not relegated to the trash heap, but rather play a central role as mentors, teachers - elders.
