Presidents approve college football playoff

WASHINGTON (AP) ? Playoffs and tournaments long have determined champions of every college sport from baseball to bowling.

The exception was major college football.

That ended Tuesday. Come 2014, the BCS is dead.

A committee of university presidents approved a plan for a four-team playoff put forward by commissioners of the top football conferences.

The new system doesn't go too far, Virginia Tech President Charles W. Steger said.

"It goes just the right amount," he said.

The move completes a six-month process for the commissioners, who have been working on a new way to determine a major college football champion after years of griping from fans. The latest configuration is certain to make even more money for the schools than the old system.

"There were differences of views," Steger said. "I think it would be a serious mistake to assume it was a rubber stamp."

Instead of simply matching the nation's No. 1 and No. 2 teams in a title game after the regular season, the way the Bowl Championship Series has done since 1998, the new format will create a pair of national semifinals.

College football fans have been clamoring for a playoff for years, and the BCS has been a constant target for criticism. Lawmakers have railed against it. A political action committee was formed, dedicated to its destruction. The Justice Department looked into whether it broke antitrust laws. Even President Obama said he wanted a playoff.

Now it's a reality.

No. 1 will play No. 4, and No. 2 will play No. 3 on Dec. 31 and Jan. 1. The sites of those games will rotate among the four current BCS bowls ? Rose, Orange, Fiesta and Sugar ? and two more to be determined.

The winners will advance to the championship on the first Monday in January that is six or more days after the last semifinal. The first championship Monday is set for Jan. 12, 2015.

The site of the title game will move around the way the Super Bowl does, with cities bidding for the right to host.

The teams will be selected by a committee, similar to the way the NCAA basketball tournament field is set. The men's tournament has 68 teams, and 37 at-large bids.

The football committee will have a much tougher task, trying to whittle the field down to four. Among the factors the committee will consider is won-loss record, strength of schedule, head-to-head results and whether a team is a conference champion. This season, 125 schools will play at the highest level of college football.

"I think it's tremendous progress," Washington State coach Mike Leach, a playoff proponent. "Five years ago there wasn't even dialogue about a playoff. Instead of diving in the water, they dipped their toes in. I think it's' going to be ridiculously exciting and it's going to generate a bunch of money. I wish they dived in."

No one has put a hard number on it yet, but this new format figures to more than double the TV revenue of the current BCS and Rose Bowl contracts. Those pay out about $155 million annually.

The commissioners want to lock in this format for 12 years with a television partner. The current BCS deal with ESPN runs through the 2013 season. The new format will be presented to potential TV partners in the fall, starting with ESPN.

There are still some details to work out ? such as who will be on the committee and what new bowls will be involved in the semifinal rotation ? but all the decision-makers are on board.

Lower divisions of college football already have a playoff, but the highest level has always used bowls and polls to determine its champion. Those days are coming to an end.

"By making this change we felt we could enhance the regular season but at the same time provide the fans with the kind of postseason that will contribute to the regular season," Southeastern Conference Commissioner Mike Slive said.

Does the FMLA apply to employees who have domestic partners ...

Q. Several of our employees live with domestic partners. Are our employees entitled to FMLA leave to care for a partner?

A. It depends. The answer is yes, provided the requested leave is not conditioned on marriage. The FMLA entitles qualified employees of a covered employer to 12 weeks of unpaid leave each year for the following events:

  • Birth of the employee?s child or to care for the newborn child
  • Placement with the employee of a child for adoption or foster care
  • A serious health condition that makes the employee unable to perform his or her job
  • The need to care for a son or daughter, spouse or parent with a serious health condition.

To qualify for FMLA leave, the employee must have worked for the employer for 12 months and worked at least 1,250 hours over the past 12 months.

If the FMLA need arises because of the birth of a child or placement of a child in the employee?s immediate family by adoption or foster care, the worker need not be married to his or her partner to qualify for leave. Qualifying FMLA leave would also be available to the employee to care for the worker?s child or parent with a serious health condition.

The employee?s marital status only matters if he or she seeks leave to care for either an unmarried domestic partner with a serious health condition or the child of such a partner.

Although no courts have addressed this issue, the FMLA regulations define ?spouse? as a husband or wife as recognized under state law for purposes of marriage, including common-law marriage in states where it is recognized. Accordingly, if the individual with whom the employee is cohabitating is not a legal or common-law spouse, the worker is not entitled to FMLA leave to care for his or her partner.

Some question exists on leave for the purpose of caring for an unmarried domestic partner?s child.

The FMLA defines the terms ?son? and ?daughter? as biological children, adopted children, stepchildren, legal wards and children for whom the employee cares in loco parentis. A worker cares for another?s child in loco parentis when the worker takes the place of the natural parent and cares for the child as his or her own.

In some circumstances, that could be a close call. Seek legal advice before acting.

UNC-CHAPEL HILL (US) ? Mild or intense exercise, before or after menopause, may reduce the risk of breast cancer, although substantial weight gain may negate the benefits.

Published early online in Cancer, the findings indicate that women can reduce their breast cancer risk by exercising and maintaining their weight.

While studies have shown that physical activity reduces breast cancer risk, many questions remain. For example, how often, how long, and how intense does physical activity have to be to provide benefits? Also, do women with all body types experience a reduced risk when they exercise, and does exercise reduce the risk of all types of breast cancer?

To investigate, Lauren McCullough, a doctoral candidate at the University of North Carolina Gillings School of Global Public Health, and her colleagues looked for a link between recreational physical activity, done at different time points in life, and the risk of developing breast cancer.

The study included 1,504 women with breast cancer (233 noninvasive and 1,271 invasive) and 1,555 women without breast cancer who were 20 to 98 years old and were part of the Long Island Breast Cancer Study Project, an investigation of possible environmental causes of breast cancer.

Women who exercised either during their reproductive or postmenopausal years had a reduced risk of developing breast cancer. Women who exercised 10 to 19 hours per week experienced the greatest benefit with an approximate 30 percent reduced risk.

Risk reductions were observed at all levels of intensity, and exercise seemed to reduce the risk of hormone receptor positive breast cancers, the most commonly diagnosed tumor type among American women.

?The observation of a reduced risk of breast cancer for women who engaged in exercise after menopause is particularly encouraging given the late age of onset for breast cancer,? McCullough says.

When the researchers looked at the joint effects of physical activity, weight gain, and body size, they found that even active women who gained a significant amount of weight?particularly after menopause?had an increased risk of developing breast cancer, indicating that weight gain can eliminate the beneficial effects of exercise on breast cancer risk.

Co-authors of the study contributed from University of North Carolina Gillings School of Global Public Health and School of Medicine, as well as Columbia University and Mount Sinai School of Medicine.

Running With the Mind of Meditation ? Book Recommendation ...

We are all familiar with the benefits of regular physical exercise. Physical activity increases our strength, flexibility, stamina, can prevent cancer and heart disease, lower blood pressure, and keep us at a healthy weight. Physical exercise is ?also a powerful way of reducing symptoms of anxiety and depression. Many of my clients have benefitted tremendously from taking up regular physical activity, including running.

In the past few decades we are also beginning to become aware of the benefits and importance of exercising the mind. Stress is related to hearth disease, cancer, obesity, and reduced quality of life. Mindfulness meditation is a powerful way to reduce anxiety and stress, and has been linked to improved immune function and increased feelings of happiness and wellbeing.

In his new book Running With the Mind of Meditation?Sakyong Mipham discusses the benefits of exercising both mind and body and the powerful benefits mindfulness and running can have on ones life. He explains that exercising mind and body are not actually two separate things, but that they enhance and complement each other. Throughout the book, Sakyong Mipham uses his personal experiences with running and meditation to illustrate four stages of development of a running meditator. He describes building a base of fitness and stamina through mindfulness, discipline, and precision. By establishing discipline the next stage is experiencing appreciation and delight, because discipline brings with it the freedom to be truly present and enjoy the moment. The next stage is fearlessness and outrageousness, going beyond hope and fear. The final stage is inscrutability and developing unshakable confidence in your own and others? inherent basic goodness. Thus, the meditating runner goes from increasing his or her own fitness, health, and wellbeing to benefitting others. The book is full of practical tips and exercises and throughout the book the reader is left with a sense that this is completely doable and attainable for anyone who is willing to devote some time and energy to this path. Personally, I am not a runner, but this book inspired me to include a daily twenty minute brisk, mindful walk into my routine. I have noticed that including this walk has already benefitted me in several ways: I experience less stress, am better able to handle adversity, and I have more energy. I highly recommend this book to anyone who would like to make positive changes in their lives and in the lives of others.

Reviewing Your Health Insurance

Research suggests that once people have set up their health insurance, they?re unlikely to change it. But with the changes in the health insurance rebate, a lot of people are considering their policies and whether they should downsize in order to save money. Hospital Cover

The worst case scenario is that an emergency occurs and you hesitate calling the ambulance because of the cost. It?s not something I?m willing to risk.

Other Essentials In Cover

The article in the Herald suggests that one of the major problems they?re seeing is that young, healthy people are buying basic level cover that doesn?t actually help them with any health concerns. No matter how fit you are, wisdom teeth removal, replacement surgery (especially if you play any kind of sport) and psychiatric care are crucial in your cover. And while you might think you?ve got years to prepare for a cancer or heart scare, if it?s in the family, experts suggest getting coverage.

Lifetime Health Cover

A new factor in the whole debate is the lifetime health cover initiative from the Government. Basically, for every person over 30, you are expected to have taken out health insurance. For every year after your 30th birthday that you remain uninsured, there will be a 2% loading on top of the actual cost every time you end up in hospital. And that?s a 2% loading for every year from your 31st onwards. So, if you haven?t taken out health insurance, end up in hospital and you?re 40, you?re looking at an extra 20% loading. In other words, ?optional? health insurance comes with a financial penalty if you don?t insure yourself.

Rebate

There is also the private health insurance rebate, to mitigate the cost of insurance. It?s a tiered system, based on household set-up and income. You can find a complete table at the Australian government?s private health insurance website, but should be looking at a rebate of 30% for singles earning below $84,000 or families earning below $168,000.

Discovery of material with amazing properties

ScienceDaily (June 24, 2012) ? Normally a material can be either magnetically or electrically polarized, but not both. Now researchers at the Niels Bohr Institute at the University of Copenhagen have studied a material that is simultaneously magnetically and electrically polarizable. This opens up new possibilities, for example, for sensors in technology of the future. The results have been published in the scientific journal, Nature Materials.

Materials that can be both magnetically and electrically polarized and also have additional properties are called multiferroics and were previously discovered by Russian researchers in the 1960s. But the technology to examine the materials did not exist at that time. It is only now, in recent years, that researchers have once again focused on analyzing the properties of such materials. Now you have research facilities that can analyze the materials down to the atomic level.

Surprising test results

"We have studied the rare, naturally occurring iron compound, TbFeO3, using powerful neutron radiation in a magnetic field. The temperature was cooled down to near absolute zero, minus 271 C. We were able to identify that the atoms in the material are arranged in a congruent lattice structure consisting of rows of the heavy metal terbium separated by iron and oxygen atoms. Such lattices are well known, but their magnetic domains are new. Normally, the magnetic domains lie a bit helter-skelter, but here we observed that they lay straight as an arrow with the same distance between them. We were completely stunned when we saw it," explains Kim Lefmann, Associate Professor at the Nano-Science Center, University of Copenhagen.

They were very strange and very beautiful measurements and it is just such a discovery that can awaken the researchers' intense interest. Why does it look like this?

Explaining physics

The experiments were conducted at the neutron research facility Helmholtz-Zentrum in Berlin in collaboration with researchers in Holland, Germany, at ESS in Lund and at Ris?/DTU. They would like to get a general understanding of the material and with the help of calculations; and have now arrived at a more precise image of the relationship between the structure of the material and its physical properties.

"What the models are describing is that the terbium walls interact by exchanging waves of spin (magnetism), which is transferred through the magnetic iron lattice. The result is a Yukawa-like force, which is known from nuclear and particle physics. The material exhibits in a sense the same interacting forces that hold the particles together in atomic nuclei," explains Heloisa Bordallo, Associate Professor at the Niels Bohr Institute.

It is precisely this interaction between the transition metal, iron, and the rare element, terbium, that plays an important role in this magneto-electrical material. The terbium's waves of spin cause a significant increase in the electric polarization and the interaction between the ions of the elements creates one of the strongest magneto-electrical effects observed in materials.

"Through these results we found a new pathway to discover and develop new multiferroics," emphasize the researchers in the group. Now it is up to further research to determine whether this new effect could lead to new applications of these materials with the amazing physical properties.

High Court's Immigration Decision Gives States Little Clarity

Despite the Supreme Court?s definitive ruling on Monday that struck down most of Arizona?s tough immigration law, the measure?s defenders can still cheer that Arizona?s local police officers are now able to routinely check the immigration status of the people they stop for other reasons. The state?s Republican Gov. Jan Brewer said she is ?grateful for this legal victory.?

But with three of the four provisions of Arizona?s law struck down (ID requirements, warrantless arrests, and criminalizing work), other states weighing similar laws are left with little certainty on how to proceed. Even if states simply want to emulate Arizona?s surviving ?show me your papers? provision, they will be vulnerable to lawsuits charging racial profiling.

The high court didn?t touch the idea of racial profiling because the federal government made the decision not to raise the thorny civil-rights issue in this case. There are several court cases pending from civil-rights groups arguing the ?show me your papers? part of Arizona?s law improperly encourages racial profiling from police officers.

Immigration is bigger than the questions raised in the Arizona case, which turned on the relatively narrow legal question about whether federal law can preempt state law. Politically, immigration has emerged as one of the hottest motivators for get-out-the-vote campaigns among Hispanics, a key voting bloc for President Obama and other Democrats seeking congressional office.

Obama?s announcement earlier this month to create a temporary deferral program for so-called ?dreamers,? undocumented youth who were brought to the United States illegally when they were children, was a not-so-subtle statement about the federal government?s preeminence on immigration policy. The announcement has the added benefit of rallying Hispanics to go to the polls to ensure that Obama?and the new policy?stays put.

Democrats, who want broader immigration overhaul including a path to citizenship for undocumented immigrants, crowed at the Supreme Court?s decision. ?Three linchpins of the Arizona law were struck down by a convincing majority of the Court as clearly violating federal law, and a fourth is on thin legal ice,? said Sen. Chuck Schumer, D-N.Y., who chairs the immigration panel on the Senate Judiciary Committee and is charged with shepherding immigration legislation through the Senate.

The Court showed some understanding about the plight of border states that bear the brunt of illegal-immigration problems. Republican Sens. Jon Kyl and John McCain, both of Arizona,?said in a joint statement that the justices validated ?a key component of Arizona?s immigration law [that] was born out of the state?s frustration with the burdens that illegal immigration and continued drug smuggling impose on its schools, hospitals, criminal justice system, and fragile desert environment.?

CIVIL RIGHTS UP NEXT

According to Arizona?s defenders, the racial-profiling charge is a red herring. They posit the U.S. government specifically avoided raising questions of racial discrimination in their arguments because such arguments would not fly.

But civil-rights groups have remained undaunted. There are several lawsuits pending in lower courts that pose completely different questions than the ones answered by the Supreme Court. The American Civil Liberties Union and other groups have challenged the Arizona law, saying it invites racial profiling and violates the First Amendment. That case is expected to go before the U.S. Court of Appeals for the Ninth Circuit, the same circuit that agreed with the federal government that Arizona overstepped its bounds in enacting the law.

Alabama, South Carolina, Georgia, and Utah have enacted laws similar to Arizona?s requiring police officers to investigate the immigration status of all persons they stop if there is ?reasonable suspicion? that they are in the country illegally. They can only rest assured that those provisions will survive scrutiny on federal-preemption questions, not on questions about civil rights.

The Alabama law goes further than Arizona?s statute, requiring school officials to inquire about the immigration status of students. Civil-rights groups have a lawsuit pending against that state as well, saying its immigration law chills children?s access to public schools, invites racial profiling, and criminalizes state residents for everyday interactions with undocumented individuals.

WHERE STATES MAY NOT TREAD

Elected state officials have legitimately complained that more needs to be done to fix the byzantine immigration law, which hasn?t seen a serious overhaul in 18 years. Yet the Supreme Court was clear in its decision that the states are at most sidekicks in the enforcement of immigration law.

Immigration is the federal government?s show, and it will continue to be so despite Arizona?s efforts and complaints. Just look at what the high court said when it struck down the part of the Arizona law making it a crime for an undocumented immigrant to not have registration papers??States may not enter, in any respect, an area the Federal Government has reserved for itself,? said Justice Anthony Kennedy. It?s hard to get clearer than that.

And here?s what the Court had to say about Arizona?s idea to allow police officers to make warrantless arrests of people they believe are in the country illegally: ?Detaining individuals solely to verify their immigration status would raise constitutional concerns.? Yep. The Court read the Immigration and Nationality Act correctly. Deportation, detention, asylum?they are all actions that the federal government alone takes.

It isn?t all bad for the states. They can now claim that they are perfectly within their rights to assist the federal government in enforcement activities and can even pass laws to clarify their roles. Local police cooperate with federal officials now through the Homeland Security Department?s ?Secure Communities? program, in which local and federal officers share information about the legal status of people who have been detained for other reasons. Local police don?t need special training to do this, although the decision about what ultimately happens to these people lies with those who understand the nuances of the complex law.

?Consultation between federal and state officials is an important feature of the immigration system. Congress has made it clear that no formal agreement or special training needs to be in place for state officers to ?communicate with the [Federal Government] regarding the immigration status of any individual,? ? Kennedy wrote.

There is still the ?effectiveness? question, which the Supreme Court did not (and arguably cannot) answer. Is the federal government doing enough to secure the border and curb illegal immigration? Arizona?s defenders say the preponderance of state laws weighing in on immigration means that the answer is an unequivocal "no."

No matter how many ways you parse the Supreme Court?s ruling, that conversation will go on.

'Newsroom': Five Reasons To Watch

New HBO series stars Jeff Daniels and is penned by 'Social Network' and 'West Wing' writer Aaron Sorkin.

HBO is on quite a roll with its Sunday night programming. In the wake of TV series success stories like "The Sopranos," "True Blood," "Game of Thrones," "Veep" and "Girls," the award-winning cable network has developed and debuted yet another buzzworthy show, "Newsroom."

Why is it buzzworthy? Because it's written and created by Oscar, Golden Globe and Emmy winner Aaron Sorkin and it's a television show about television, specifically the behind-the-scenes drama involved in the production of a nightly news show. The major characters include a hotheaded and egocentric anchor (Jeff Daniels), his strong-willed-yet-soothing executive producer and ex-girlfriend (Emily Mortimer), their jovial and bourbon-loving boss (Sam Waterston), and the idealistic newbie (Alison Pill) who's dating a senior producer. There's much to love and hate judging from the mixed reviews from critics, but we're totally hooked. Here are five things to love about "Newsroom."

Sorkin Speak
Aaron Sorkin didn't win a Best Screenplay Oscar for "The Social Network" or Emmys galore for "The West Wing" for nothing. The man can write the heck out of dialogue. Say what you will about the pretentiousness, preaching and politics involved in an action-packed pilot that calls out America (and the mainstream media) for not being as good as it can be, but Sorkin moves things along at a crackling clip complete with pop-culture references from sources ranging from Twitter to Don Quixote.

Going Back to the Future
"Newsroom" is set in 2010 and the first episode revolves around the news of the BP oil spill. The show's unique setting allows Sorkin to write around, and in some ways re-write, history, giving the "News Night" team the fictionalized plotline of being the only major news program to dedicate considerable airtime to early reports. Each episode will deal with fictionalized perspectives on memorable real-life news events and how they were reported.

Inside Baseball
Sorkin loves his behind-the-scenes-style stories — see his previous shows "Sports Night," "The West Wing" and "Studio 60 on the Sunset Strip." In setting a show around something with which we're all familiar (TV news, the White House) on a superficial level and then adding a healthy dose of interpersonal drama that everyone goes through at their respective places of work, Sorkin piques interest quite effectively. With "Newsroom," the majority of the population can relate to watching TV news at some point in their lives, and Sorkin is using that to his advantage to draw in the audience as well as challenge them to think more critically about what they watch. We shouldn't have to point out that it's all a highly romanticized version of the real story, but there you have it.

Jeff Daniels
Although his comedic brilliance in "Dumb and Dumber" will live on forever, Daniels' equally special skills as a dramatic actor are on full display in playing "News Night" anchor Will McAvoy. He is arrogant and self-obsessed, moody and unpredictable, which might all come off as a bland stereotype were the role in less adept hands than Daniels'. In short, McAvoy isn't all bark and bite and blowhard. There are finely flawed layers to slowly peel away as we greet new sides of his character in each episode.

Sam Waterston (and Other Support Cast)
It would be a disservice to lump all of the other castmembers into one brief blurb, so this week's "Newsroom" MVP award goes to Sam Waterston for bringing wit and lasting charm to the character of OG newsman Charlie Skinner. There's a lot to like about Skinner since he's the big bad boss making sure "News Night" continues to exist, in the process not firing the overly opinionated anchor, and re-hiring said anchor's former flame. He clearly has a backbone, integrity and an eye for talent, even if that eye is frequently blurry from day drinking.
